The passage of the 2018 Farm Bill answered any lingering questions about the legality of purchasing and consuming CBD at the Federal level. The Farm Bill removed CBD from the Schedule 1 list of drugs, essentially legalizing the bill at the federal level.
However, in the United States, each state is free to set their own laws and regulations – so, just because something was legalized at the federal level doesn’t mean it can be legal to do in every state!
Fortunately for residents of the Lone Star State, CBD is legal in Texas. This means that Texas residents are free to purchase and consume CBD, and this means you can purchase something in a physical store or over the internet. Is CBD Oil legal in Texas?
Yes! CBD oil is legal in Texas. While there was some confusion about CBD’s legal status in Texas until recently, that changed with Texas Governor Greg Abbott signed Senate Bill 1325 into law.
The bill did two things. First, it set up a process for government regulations to be promulgated by the Texas Department of Agriculture which will govern the process by which CBD can be manufactured, sold and consumed in Texas. Second, it makes it official: CBD is legal to buy and consume in Texas, as long as that CBD has less than .3% THC, or Tetrahydrocannabinol, which is the psychoactive ingredient in marijuana which is responsible for intoxication.
This part cannot be stressed enough: CBD is not marijuana! While both come from the cannabis plant, the growth and manufacturing of the two is totally different, and taking CBD will not result in the intoxication which marijuana is commonly associated with. Indeed, Governor Abbott has gone out of his way to say that CBD legalization did not decriminalize marijuana.
Government Regulations and Consumer Protections
Texas’ Department of Agriculture is supposed to have temporary regulations available by September 2019, but they aren’t out yet. If Texas’ CBD regulations run like other states, sellers and growers will likely need licenses and inspections in order to be able to sell their products. They will also likely have random testing of products to ensure accuracy of labeling – something that CBD INKA already does.
Industrial Hemp in Texas
Industrial hemp was legalized in Texas in April of 2017, when Governor Abbott signed HB 3507 into law. Hemp is a growing industry across the United States, and this growth is largely fueled by the increasing demand for CBD.
However, hemp cannot be grown yet in Texas. That’s because the state is waiting on the United States Department of Agriculture to release its rules on state hemp programs. From there, the state will develop a plan and submit it to the Governor, Attorney General and United States’ Department of Agriculture for approval. Hemp growth is estimated to be legalized in Texas in 2020.
